Terms and Conditions

These Terms and Conditions ('Terms') govern your use of the Mendly mobile application ('App') operated by Christopher Joseph Puthiakunnel ('we,' 'us,' or 'our'). By downloading, installing, or using Mendly, you agree to be bound by these Terms. If you do not agree, do not use the App. These Terms should be read alongside our Privacy Policy, which is incorporated by reference.

Section 1 — Eligibility

You must be at least 13 years of age to use Mendly. By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Mendly is available globally through the Apple App Store. You are responsible for ensuring your use of the App complies with the laws of your jurisdiction.

Section 2 — Nature of Mendly — Important Health Disclaimer

Mendly is a self-awareness and self-compassion tool. It is not a medical device, a clinical mental health service, or a substitute for professional mental health treatment. Nothing in Mendly — including the tap mechanic, voice note prompts, insights, milestone cards, or any content within the App — constitutes medical advice, psychological diagnosis, or therapeutic treatment. If you are experiencing a mental health crisis, suicidal thoughts, or severe psychological distress, please contact a qualified mental health professional or emergency services immediately. Mendly includes links to crisis resources within the App. The self-compassion and self-awareness practices facilitated by Mendly are based on publicly available research and are intended for general wellbeing. Individual results vary and are not guaranteed.

Section 3 — Account Registration

You must create an account to use Mendly. You agree to:

  • Provide accurate and truthful information when creating your account
  • Keep your login credentials secure and not share them with others
  • Notify us immediately at privacy@mendly.app if you suspect unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

Section 4 — Subscriptions and Payments

4.1 Free Trial

Mendly offers a 14-day free trial of the premium subscription. Your trial begins when you first subscribe and no payment is taken during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

4.2 Subscription Pricing

Mendly offers the following subscription options:

  • Annual subscription: USD $59.99 per year (or local equivalent)
  • Monthly subscription: USD $7.99 per month (or local equivalent)

Pricing may vary by region. The price applicable to you is displayed in the App before you subscribe.

4.3 Billing and Renewal

Subscriptions are billed through the Apple App Store and managed by Apple. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Apple charges your payment method on file upon renewal.

4.4 Cancellation

You can cancel your subscription at any time through your Apple ID settings (Settings > [Your Name] > Subscriptions). Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except as required by applicable law or Apple's refund policies.

4.5 Price Changes

We may change subscription prices at any time. If we increase the price of your current subscription, we will notify you in advance and you will have the option to cancel before the new price takes effect.

4.6 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policy. We do not process refunds directly. To request a refund from Apple, visit reportaproblem.apple.com.

Section 5 — Acceptable Use

You agree to use Mendly only for its intended purpose — personal self-awareness and self-compassion practice. You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract the source code of the App
  • Attempt to circumvent any security measures or access controls
  • Use the App to harass, harm, or exploit others
  • Upload or record any content that is illegal, harmful, or violates the rights of any third party
  • Use automated means to interact with the App
  • Interfere with the operation or servers of the App

We reserve the right to suspend or terminate your account if you violate these provisions.

Section 6 — Your Content — Voice Recordings

6.1 Ownership

You own your voice recordings. We do not claim any ownership over content you create within Mendly. Your voice recordings are yours.

6.2 Licence for Research Use

If you opt in to research use of your voice data (as described in our Privacy Policy, Section 3), you grant us a limited, non-exclusive, royalty-free licence to use anonymised versions of your voice recordings for the purposes of improving the App and conducting research. This licence is revocable at any time by withdrawing your consent in Settings. Upon withdrawal, your recordings are removed from any research pool and this licence terminates with respect to future use. Any use already completed under this licence prior to withdrawal is not affected.

6.3 No Monitoring

We do not monitor, listen to, or access the content of your voice recordings unless you have explicitly consented to research use. Even with research consent, access is limited to anonymised, de-identified recordings used for the purposes described.

Section 7 — Intellectual Property

All content within the Mendly App — including but not limited to the App design, graphics, user interface, text, branding, and software code — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any App content without our prior written consent. The Mendly name and logo are our trademarks. The shareable milestone cards generated by the App are for your personal use and sharing on social media. You may share them freely for personal, non-commercial purposes.

Section 8 — Privacy

Your use of Mendly is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you confirm you have read and understood our Privacy Policy.

Section 9 — Third-Party Services

Mendly integrates with third-party services including Firebase, RevenueCat, PostHog, and the Apple App Store. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services. Links or references within the App to third-party websites or services are provided for your convenience only. We do not endorse and are not responsible for third-party content.

Section 10 — Crisis Resources and Safety

Mendly includes links to crisis support resources within the App. These are provided for your safety and convenience. We are not affiliated with or responsible for the services provided by these third-party crisis resources. If you are in immediate danger, call your local emergency services. The inclusion of crisis resources in Mendly does not create a duty of care or therapeutic relationship between you and us.

Section 11 — Disclaimer of Warranties

Mendly is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be uninterrupted, error-free, or free of viruses
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties that the App will meet your specific requirements or expectations

We do not warrant that the self-awareness or self-compassion outcomes described in the App will be achieved by any particular user.

Section 12 — Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Mendly, including but not limited to:

  • Loss of data, including voice recordings
  • Personal injury or emotional distress
  • Loss of revenue or profit
  • Any reliance on App content as medical or psychological advice

Our total liability to you for any claim arising from your use of Mendly shall not exceed the amount you paid us in subscription fees in the twelve months preceding the claim, or USD $100, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

Section 13 — Indemnification

You agree to indemnify, defend, and hold harmless Mendly and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

Section 14 — Termination

14.1 By You

You may stop using Mendly and delete your account at any time through Settings > Delete Account. Deleting your account terminates these Terms with respect to your use, except for provisions that by their nature should survive termination.

14.2 By Us

We may suspend or terminate your access to Mendly at any time with or without notice if we reasonably believe you have violated these Terms, engaged in conduct harmful to other users, the App, or us, or if required by law.

14.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Section 15 — Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App and update the effective date. Your continued use of Mendly after notice of changes constitutes your acceptance of the updated Terms. If we make changes that materially affect your rights regarding voice data, we will seek fresh explicit consent rather than relying on continued use.

Section 16 — Governing Law and Disputes

These Terms are governed by the laws of Thailand, without regard to conflict of law principles. When Mendly registers as a legal entity in Malaysia, these Terms will be updated to reflect Malaysian law as the governing law. Any dispute arising from these Terms or your use of Mendly will first be subject to good-faith negotiation. If negotiation fails, disputes will be resolved by binding arbitration or in the courts of the governing jurisdiction, as applicable. Notwithstanding the foregoing, you retain the right to bring individual claims in small claims court and to seek injunctive relief to protect intellectual property rights.

Section 17 — Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms continue in full force and effect.

Section 18 — Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mendly with respect to your use of the App and supersede all prior agreements, understandings, and communications.
